H-2B Visa Cap Likely Reached for FY 2025 – Awaiting DHS Guidance

The H-2B visa cap for the second half of Fiscal Year 2025 was likely reached in early March, yet the Department of Homeland Security (DHS) has not officially confirmed it or provided guidance on when employers can begin applying for returning worker visas for start dates beginning April 1. According to the supplemental visa rule issued in November, applications for these additional visas should open 15 days after the cap is met. Immediate action from Congress is needed to ensure DHS follows through with this timeline and makes the visas available in time for the critical spring and summer hiring seasons.
